This policy explains how Functional LLC, DBA Now Agent Ready ("Now Agent Ready", "we", "us") collects, uses and shares personal information when you visit nowagentready.com or nowagent.app, sign up, use our free scan, or use the Service. Our Service is offered in the United States only.

1. Who we are

2. Notice at collection

This section is our notice at collection, including for California residents. It lists what we collect, why, and how long we keep it. We don't sell personal information for money. When ad pixels are on, sharing data with ad platforms can count as "selling" or "sharing" under some state laws. You can opt out at any time; see Your privacy choices.

We don't collect sensitive personal information as defined by California law, except card data, which Stripe handles for payment only.

3. Where we get information

From you: signup forms, the free scan, the dashboard, emails, texts and calls.
Automatically: cookies, pixels and similar technology when you visit our site.
From Stripe: card brand, last 4 digits and payment status.
From ad platforms: click IDs attached to links you tap in an ad.
From public sources: when you run our free scan, we read your business's public website and listings.
From your customers and their AI assistants: booking requests made with your business.

4. How we use information

To provide, operate and support the Service, including publishing your business for AI assistants.
To bill you, send booking emails and weekly reports, and tell you about launch and changes.
To send marketing emails (you can unsubscribe in any of them) and, if you opt in, text messages.
To measure and improve our site, product and ads.
To prevent fraud and abuse, keep the Service secure, and comply with law.

5. Analytics, session replay and ad pixels

PostHog (US cloud): product analytics, heatmaps, performance, error reporting and session replay. All form inputs are masked in recordings, so we don't see what you type. PostHog traffic is proxied through our own domain.
Meta Pixel and Conversions API, TikTok Pixel and Events API, Google tag and Google Ads conversions, Reddit Pixel and Conversions API: these tell the ad platforms when someone who clicked an ad visits or signs up, so we can measure and improve our ads. For signups we may send a hashed (scrambled) email and phone, IP address, user agent and click IDs from our server.
When your browser sends Global Privacy Control, none of the above load or fire, and we don't send your data to ad platforms from our server.

Cloudflare: hosting, content delivery, security, bot protection (Turnstile) and our database.
Stripe: card saving and payments. Stripe's privacy policy applies to the card data it handles.
Our own mail server: we send and receive email on infrastructure we operate.
PostHog: analytics and session replay.
Meta, TikTok, Google and Reddit: ad measurement, as described above, unless you opt out.
A text-messaging provider, if you opt in to texts.
AI assistants and search engines: the business information you choose to publish (not your personal account data).
The business a customer books: that customer's booking details.
Professional advisers, authorities and acquirers: when required by law, to protect rights and safety, or as part of a merger or sale.

Mobile information. We don't sell, rent or share mobile phone numbers or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes. Text-messaging originator opt-in data and consent are never shared with any third party, except the providers that deliver our messages.

7. Your privacy choices

Opt out of sale/sharing and targeted advertising. Turn on Global Privacy Control (GPC) in your browser or extension. We treat GPC as a valid opt-out of sale and sharing, and we honour it automatically: ad pixels, server-side ad events and PostHog don't run. We don't detect GPC in this browser right now.You can also email hello@nowagentready.com with the subject "Do not sell or share" and we'll apply the opt-out to your account and any email or phone number you give us.

Marketing email: use the unsubscribe link in any marketing email.
Texts: reply STOP to any text. See SMS Terms.
Cookies: you can block or delete cookies in your browser settings.
Close your account and remove your card: go to nowagentready.com/cancel.

8. Your rights

Depending on where you live, you may have the right to know and access the personal information we hold about you, to correct it, to delete it, to get a portable copy, to opt out of sale, sharing and targeted advertising, and to limit the use of sensitive information. We won't discriminate against you for using these rights.

To make a request, email hello@nowagentready.com or call (650) 247-4005. We'll verify your request by confirming control of the email or phone on your account, and respond within 45 days. An authorized agent may make a request for you with your signed permission. If we deny your request, you may appeal by replying to our decision; we'll respond to appeals within 60 days.

If you're a customer of a business that uses our Service, we process your booking data on that business's behalf. Please contact the business first. We'll help them respond.

9. Security

We use encryption in transit (HTTPS everywhere), access controls and least-privilege credentials. Card numbers are handled by Stripe on its hosted page and never touch our servers. No system is perfectly secure; if a breach affects you, we'll notify you as the law requires.

10. Children

The Service is for businesses and isn't directed to children under 16. We don't knowingly collect their personal information.

11. Where data is processed

We serve US businesses only. Data is processed in the United States and wherever our providers, such as Cloudflare, operate their networks.

12. Changes

We'll post updates here with a new "Last updated" date. For material changes, we'll email account holders before they take effect.
